There is no doubt that artificial intelligence plays an important role in the functioning of investigative and criminal courts, as well as in cybersecurity. This research addresses the impact of artificial intelligence on the legal field in all its aspects, starting from investigation procedures to the issuance and enforcement of criminal decisions. The study also examines international experiences in applying artificial intelligence within judicial systems. It further discusses the impact of cybercrimes on the judicial process and their overall effect on technological and information systems, including types of cyberattacks and aspects of preventive digital security.
In addition, the research explores how artificial intelligence can be involved in committing crimes that affect the judicial domain, as well as methods for combating such crimes and detecting suspicious activities. The study also highlights the implementation of a hybrid system within criminal courts.
To address the legislative gap in the currently applicable Iraqi Penal Code, particularly the lack of explicit criminalization of cybercrimes, the research proposes a draft law that criminalizes all acts related to information security. Finally, the study presents key findings and recommendations aimed at achieving its objectives.
